Like most website operators, The CarbonNeutral Company gathers from users of the Website Non-Personally-Identifying Information of the sort that Web browsers, depending on their settings, may make available. The CarbonNeutral Company collects both Non-Personally-Identifying Information and Personally-Identifying Information (as described in the Sections titled “Personally-Identifying Information Submitted by Using the Personal Offset Calculator” and “Personally-Identifying Information Submitted by Using the Business Carbon Calculator” below) from users who use the Personal Offset Calculator and the Business Carbon Calculator. The CarbonNeutral Company collects the following Non-Personally-Identifying Information from the Personal Offset Calculator and the Business Carbon Calculator:
- (1) Users of the Personal Offset Calculator will submit individual or collective household information including (a) flight airport pairings with the class of flights and the number of people flying; (b) the number of flights and the type of flight; (c) the specific car or general class of car driven and how much it has been used; (d) the amount of energy used (e.g., electricity, compressed gas, oil, LPG) over a specified time period; (e) the percentage of electricity that comes from clean, renewable sources such as solar wind; (f) the amount of non-recycled waste produced over a specified time period; (g) the amount and frequency of regular travel (i.e., commuting) including by car, motorcycle, train, light rail or tram, bus or coach, tube or subway, and ferry; (h) manually entered tonnes of emissions; (i) a choice of carbon offset portfolio;
- (2) Users of the Business Carbon Calculator will submit information including (a) the number of employees; (b) the floor area; amount of electricity, natural gas and oil used; and the amount of incinerated waste and waste delivered to landfill, for every site and location of the business during the specified time period; (c) the distance driven or amount of fuel used (e.g., petrol, diesel, LPG) for vehicles owned or operated by the company and those used in business travel by the company; (d) other business travel (distance and/or quantity) by taxi, train, and flights (short-haul and long-haul); (e) the amount of regular travel to work by employees and the corresponding distance (i.e., commuting) which including by car, motorcycle, train, light rail or tram, bus or coach, tube or subway, and ferry.
The CarbonNeutral Company analyzes the Non–Personally–Identifying Information gathered from users of the Personal Offset Calculator and the Business Carbon Calculator to help The CarbonNeutral Company better understand how the Website is being used as described above. From time to time in its sole and absolute discretion, The CarbonNeutral Company may also release such Non–Personally–Identifying Information in the aggregate. The CarbonNeutral Company also combines the Non-Personally-Identifying Information gathered from users of the Personal Offset Calculator and the Business Carbon Calculator with Personally-Identifying Information gathered from users of the Website and uses and discloses such information as described in the section titled “Collection, Use and Disclosure of Personally-Identifying Information” below and releases such combined information in the aggregate.
Campaigns and Surveys
The CarbonNeutral Company may conduct Campaigns and Surveys at the Website from time to time. Campaigns and Surveys collect both Non-Personally-Identifying Information and Personally-Identifying Information provided by users at the time that they register to participate, if ever. The CarbonNeutral Company may collect the following Non-Personally-Identifying Information from Campaigns and Surveys: personal and/or company emissions and statistics, personal and/or company emission reductions and savings, and statements of environmental policy and opinion.
Campaigns and Surveys help The CarbonNeutral Company improve its services and products. Such Non-Personally-Identifying Information gathered from Campaigns and Surveys may be analyzed and disclosed in aggregated form.
Collection, Use and Disclosure of Personally–Identifying Information
As defined above, Personally-Identifying Information is information that can be directly associated with a specific person or entity (such as a name or email address) without the aid of additional information. The CarbonNeutral Company collects a range of Personally-Identifying Information from and about Website users. Users of the Website are under no obligation to provide The CarbonNeutral Company with Personally–Identifying Information of any kind, with the caveat that a user’s refusal to do so may prevent the user from using certain Website features.
Personally-Identifying Information Submitted by Campaign and Survey Registration
In addition to the Non-Personally-Identifying Information provided by registrants of the Campaigns and Surveys (as described in the Section titled “Campaigns and Surveys” above), registrants of the Campaigns and Surveys may also provide the following Personally-Identifying Information through their registration of the Campaigns and Surveys: contact information including the participant’s first and last name, email address, company name (if applicable), address, city, state, zip code, country of residence, telephone number, cell phone number and the like. The CarbonNeutral Company will use and disclose such Personally-Identifying Information as described herein.
Personally-Identifying Information Submitted by Using the Personal Offset Calculator
In addition to the Non-Personally-Identifying Information provided by users of the Personal Offset Calculator (as described in the Section titled “Offset Calculators” above), users of the Personal Offset Calculator may also provide the following Personally-Identifying Information through their use of the Personal Offset Calculator: the region they live in. The CarbonNeutral Company will use and disclose such Personally-Identifying Information as described herein.
Personally-Identifying Information Submitted by Using the Business Carbon Calculator
In addition to the Non-Personally-Identifying Information provided by users of the Business Offset Calculator (as described in the Section titled “Offset Calculators” above), users of the Business Carbon Calculator may also provide the following Personally-Identifying Information through their use of the Business Carbon Calculator: the business site’s country location. The CarbonNeutral Company will use and disclose such Personally-Identifying Information as described herein.
Contacting The CarbonNeutral Company for Information
When users contact The CarbonNeutral Company to request more information about The CarbonNeutral Company products and services, each user may provide Personally-Identifying Information such as a name, company name, email address and telephone number. The CarbonNeutral Company may engage third parties to administer customer service on its behalf from time to time in its sole discretion.
Notices of Violations of Website Terms of Service and Other Communications Directed to The CarbonNeutral Company
By submitting a communication (including communications about content stored on or transmitted through the Website) to The CarbonNeutral Company, you consent to have such communication forwarded to the person or entity who stored or transmitted the content addressed by your communication, in order to facilitate a prompt resolution. Upon written request The CarbonNeutral Company will edit out your name and contact information.
The CarbonNeutral Company may email users about products and services that The CarbonNeutral Company believes may be of interest to them. The CarbonNeutral Company also may provide users’ email information to third parties so that those third parties may directly contact users about additional products and services that The CarbonNeutral Company believes may be of interest to them. Succeeding the point in time that The CarbonNeutral Company has collected an email address from a user, if a user wishes to prospectively opt-out of having their email information provided to third parties at any time, they may do so by sending The CarbonNeutral Company an email at email@example.com. Even after opting-out, a user may continue to receive marketing emails from third parties to whom The CarbonNeutral Company already has provided the user’s email information. Users will be responsible for directly contacting such third parties to request cessation of further marketing emails.
As described in the previous subsections of this “Collection, Use and Disclosure of Personally–Identifying Information” section, users may, at their option, disclose their own Personally-Identifying Information by any means they choose, including without limitation through registering with the Website, using the Personal Offset Calculator, using the Business Carbon Calculator and contacting The CarbonNeutral Company (including third parties engaged by The CarbonNeutral Company) for additional information about The CarbonNeutral Company products and services. The CarbonNeutral Company discloses Personally–Identifying Information to The CarbonNeutral Company employees, contractors, affiliates, third party service providers, vendors, suppliers and intermediaries, such as credit card authorization companies, who process Personally–Identifying Information on The CarbonNeutral Companies behalf, or participate with The CarbonNeutral Company in the provision or operation of the Website (including without limitation The CarbonNeutral Company, LLC). Personally-Identifying Information may be stored on servers in the United States and in foreign jurisdictions, and, as a result, may be subject to access requests from law enforcement in such jurisdictions.
